PMG保證

Paper Money Guaranty, LLC (“PMG”) PMG provides the following guarantee for PMG-graded paper currency notes. Notes must be encapsulated in PMG holders to be eligible for the PMG Guarantee.

  • All paper currency notes graded by PMG and encapsulated in a PMG holder (which are collectively referred to as “Notes” in this guarantee) are guaranteed to be genuine.

  • All Notes are guaranteed not to be overgraded, meaning that they are not graded higher than PMG’s grading standards.
    • Note: The grade guarantee does not apply to Notes given a “Net” grade by PMG, meaning the word “Net” follows the numerical grade on the PMG certification label. Notes with “Net” grades are guaranteed to be genuine only.

The owner of any PMG-certified Note believed to be not genuine or overgraded may submit it to PMG under its Appearance Review service. If PMG determines, in its sole opinion, that the Note is not genuine or that the correct grade for the Note is lower than the one originally assigned, PMG will provide one of the three remedies described below. The choice of remedy will be made by PMG in its sole discretion, and the remedies are subject to the further limitations set forth below. Current Fair Market Value is determined solely by PMG as described in each of the listed remedies and the “Fair Market Value” paragraph that follows.

PMG可以(a)將紙鈔裝封並貼標說明最新鑒定的正確(較低)評級;以及(b)向提交者支付按照錯誤標準(較高)評級紙鈔的當前公允市場價值與最新鑒定正確(較低)評級紙鈔的公允市場價值之間的差價。

PMG可以從提交者處購買紙鈔。若紙鈔被認定評級過高,PMG所支付的價格為公司按照原本錯誤等級評估之紙鈔的當前公允市場價值。若紙鈔被認定為贗品,PMG將支付於正確評級的真實紙鈔之公允市場價格,或支付提交者在實際公平交易中就該紙鈔支付的價格二者之中較低的價格,加上任何提交者提交紙鈔以獲得PMG重審服務所產生的郵費,運輸費或其他雜費。

PMG可以保留非真實的紙鈔或評級高估的紙鈔並替代性地向提交者提供與該紙鈔原定PMG評級相等的真品紙鈔。

  1. PMG may (a) return the Note to the submitter encapsulated with a label indicating the newly established correct (lower) grade and (b) pay to the submitter the difference between the current Fair Market Value of an accurately graded Note at the original incorrect (higher) grade and the current Fair Market Value of the Note at the newly established correct (lower) grade.
  2. PMG may purchase the Note from the submitter. If the Note was determined to be overgraded, the price PMG pays will be the current Fair Market Value of an accurately graded Note at the original incorrect grade. If the Note was determined to be not genuine, PMG will pay the lesser of the Fair Market Value of an accurately graded, genuine Note or the amount actually paid for the Note by the submitter in an actual arm's length transaction, plus any postage, shipping or other incidental expenses incurred by the submitter in submitting the Note for Appearance Review service by PMG.
  3. PMG may retain the not genuine or overgraded Note and provide to the submitter in its place an equivalent Note that is genuine and has the same grade as PMG originally assigned to the Note.

Fair Market Value. PMG will determine, if and as necessary, and in its sole discretion, the current “Fair Market Value” of the Note if it were to be sold. This determination will be made for an accurately graded Note at the original incorrect (higher) grade and, if applicable, for the Note at the newly established correct (lower) grade. PMG will determine the current Fair Market Value of a Note based upon what PMG believes, in its sole opinion, to be reliable current market information. PMG may use actual pricing and sales information available to it, including prices in the actual transaction history of the Note in question. However, due to the volatile nature of the Note market and Internet auctions/sales as well as the differences in buying habits of different individuals, such information may not necessarily represent the accurate current Fair Market Value of any particular Note, which again, will be determined by PMG in its sole discretion.

WARNING: THIS GUARANTEE IS LIMITED. The following terms, limitations and restrictions apply with regard to the above guarantee and available remedies, and the submitter of a Note using PMG’s Appearance Review service agrees to be bound by all of the terms, conditions and limitations set forth herein:

警告:本保證是有限的。下述條款,限制以及約束適用於上述保證以及可適用的補救措施,提交紙鈔進行PMG重審服務的提交者同意接受本保證中的條款,條件和限制的約束。

不當儲存。若被提交進行重審服務的紙鈔相較PMG原本對其指定的評級存在過低評級的情況,PMG保證將不適用,但評級護套是否遭受濫用,改動或在不當條件下儲存,例如(但不限於)極端的溫度、濕度、致害環境條件、過度光照,過度晃動或振動或任何其它極端環境,均由PMG基於其自由裁量確定。

屬性。紙鈔的屬性特徵不屬於保證的範疇,包括種類歸屬特徵、背景歸屬特徵及譜系歸屬特徵。此外,PMG並不保證一定能認定某一特定種類或名稱的紙鈔。與紙鈔屬性相關的政策如有變更,恕不另行通知。

書寫或機械性錯誤。書寫(“機械性”)錯誤出現在紙鈔被裝封並貼標說明紙鈔的評級和/或描述時,該評級和/或描述被熟悉PMG評級系統且進行過完整的PMG認證紙鈔檢查和PMG認證標籤檢查的收藏家認定有失準確。紙鈔的買賣雙方有責任檢查該紙鈔是否有書寫錯誤,並在保證期內將其歸還以進行更正。當PMG基於其自由裁量確定決定一個書寫錯誤導致了紙鈔的錯誤評級或描述時,PMG保證將不適用。若有要求,PMG將對書寫錯誤進行補償,補償方式為免費更新裝封並恰當貼標。

PMG certification labels with incorrect dates, catalog numbers, denominations and Note types (all of which should be obvious to someone who performs an inspection of the Note and label) are considered clerical errors. Examples of such errors include, but are not limited to, the following:

  1. Required Information. In fulfillment of the PMG Guarantee, PMG may require that the submitter provide information regarding the transaction history of a particular Note, including the date purchased, the purchase price, the seller and the transaction amount. PMG may also require that a submitter attempt to reverse a prior transaction. The submitter acknowledges that his or her inability to provide requested information and / or non-cooperation hinders PMG from fulfilling its commitment under the terms of this Guarantee, and in such cases PMG shall not be required to provide any of the listed remedies.
  2. PMG Holders. The PMG Guarantee does not apply to Notes that have been removed from their PMG holder, or if the PMG holder containing a Note has been damaged, unsealed, tampered with or altered. The determination as to whether this has occurred shall be at the sole discretion of PMG. Further, the PMG Guarantee does not apply to counterfeit or tampered PMG holders.
  3. Improper Storage. The PMG Guarantee does not apply if Note submitted for Appearance Review is determined to have a lower grade than that originally assigned to it by PMG, but it is also determined by PMG that the holder has been subject to abuse, alteration or improper storage conditions such as (but not limited to) extreme temperature, moisture, damaging environmental conditions, excessive light, excessive motion or vibration or any other extreme conditions.
  4. Attributions. Attributions, including variety attributions, reference attributions and pedigree attributions are NOT guaranteed. Further, PMG does not guarantee that a particular variety or designation will always be recognized, and attribution policies are subject to change without notice.
  5. Clerical or “Mechanical” Errors. A clerical (“mechanical”) error occurs when a Note is encapsulated with a label that bears a grade and/or description that a collector familiar with the PMG grading system and who performed a thorough inspection of both the PMG-certified Note and the PMG certification label could determine could not be accurate. It is the duty of the buyer and seller of a Note to examine such Note for a clerical error to return such Notes for correction when warranted. The PMG Guarantee does not apply when PMG determines, in its sole discretion, that a clerical error has resulted in the Note having an incorrect grade or description. If requested, PMG will remedy any clerical error free of charge by updating the encapsulation to show an appropriate label.

    1. A Note label description references a catalog number of Pick 872, when the Note actually has a catalog number of Pick 572.
    2. A Note label description references a 1911 date when the Note is actually dated 1910.
    3. A Note denomination is identified as $500 when the Note is actually a $50.
    4. A Note is graded 68 Superb Gem Unc when it should have been graded 58 Choice About Unc, a clerical error with respect to grade that would be obvious to a collector.
  6. PMG Registry. The PMG Guarantee does not cover a Note’s status in the PMG Registry, including eligibility or points assigned. Changes to the PMG Registry may be made without notice, and PMG does not guarantee that a Note will always be eligible for inclusion in the PMG Registry nor does it guarantee that it will receive a certain point score.

THE PMG GUARANTEE AS SET FORTH HEREIN IS THE ONLY WARRANTY, EXPRESS OR IMPLIED, REGARDING THE PMG-GRADED NOTES TO WHICH IT APPLIES THAT IS MADE BY PMG. IT REPLACES AND SUPERSEDES ALL OTHER WARRANTIES PREVIOUSLY MADE BY PMG, EXPRESS OR IMPLIED. PMG MAKES NO WARRANTY OF MERCHANTABILITY, FITNESS OR OTHERWISE. THE REMEDIES PROVIDED IN THIS AGREEMENT ARE EXCLUSIVE. EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, ALL OTHER REMEDIES AGAINST PMG ARE WAIVED. IN NO EVENT WILL PMG BE LIABLE FOR ANY TYPE OF DAMAGES, INCLUDING BUT NOT LIMITED TO, CONSEQUENTIAL, PUNITIVE AND INCIDENTAL DAMAGES.

本PMG保證是PMG制定的適用於PMG評級紙鈔的唯一的、不論明示或暗示的保證。本保證應取代所有此前作出的其他保證,不論其他保證為明示作出或暗示作出。PMG並不保證紙鈔的適銷性、適用性或其它方面。本協議下提供的補救措施是排他性的。除本保證另有明確約定外,其它所有可能向PMG提出的救濟於此已被放棄,包括但不限於間接損失、懲罰性賠償和附帶損害賠償。

THIS GUARANTEE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF FLORIDA AS APPLIED TO TRANSACTIONS TAKING PLACE WHOLLY WITHIN FLORIDA BETWEEN FLORIDA RESIDENTS. CLAIMANTS UNDER THIS GUARANTEE HEREBY WAIVE TRIAL BY JURY AND EXPRESSLY CONSENT, AT THE OPTION OF PMG, (1) TO THE PERSONAL AND SUBJECT-MATTER JURISDICTION OF THE STATE AND FEDERAL COURTS LOCATED IN AND FOR THE COUNTY OF SARASOTA, STATE OF FLORIDA, OR (2) TO ARBITRATION BEFORE THE AMERICAN NUMISMATIC ASSOCIATION OR THE PROFESSIONAL NUMISMATISTS GUILD FOR ANY DISPUTE ARISING FROM OR RELATED TO THIS GUARANTEE.

本保證應適用佛羅里達州法律並據此進行解釋,視同所有交易發生于佛羅里達州內居民之間。依照本保證提出索賠的索賠人特此放棄由陪審團審判,並明示同意PMG有權單方選擇:(1) 位於佛羅里達州薩拉索塔縣的州和聯邦法院對人身和標的的管轄權,或 (2) 針對由本協議引起的或與之相關的任何爭議,可前往美國錢幣協會或專業錢幣行業協會進行仲裁。

Notwithstanding anything else contained in this PMG Guarantee, in the event of loss or damage of your Note by PMG, PMG will only be responsible for the LESSER of the actual current Fair Market Value as determined solely by PMG or the submitter declared valued.

PMG若將您的紙鈔丟失或對其造成損壞,PMG將僅賠償實際的公允市場價值或紙鈔提交者自己宣稱的紙鈔價值(以其中較低者為准),而不受本PMG紙鈔評級保證其他條款的約束。

The PMG Guarantee has been translated into Chinese. If there is any inconsistency between the English version and the Chinese version, the English version shall prevail.

PMG保證已翻譯成中文,若中英版本出現任何衝突,則以英文版本協議為准。
